Hampshire Trailer Co. – Trailer Hire Terms & Conditions (Full Draft)

1. Definitions

  • “The Company” means Hampshire Trailer Co.

  • “The Hirer” means the person renting the trailer.

  • “The Trailer” refers to the Brian James A-Transporter or any trailer supplied by The Company.

  • “Hire Period” means the duration agreed between The Company and The Hirer.


2. Hirer Requirements

2.1 The Hirer must:

  • Hold a valid UK driving licence suitable for towing (check B+E requirements if applicable).

  • Provide two forms of ID showing matching address details. Digital photos of ID are accepted, but originals may be requested for verification.

  • Ensure their vehicle is legally capable of towing the trailer and intended load (GTW / towing capacity).

2.2 The Hirer is responsible for ensuring their vehicle’s electrics and towing equipment are in safe working order.


3. Payment and Deposits

3.1 The following are due upon collection:

  • Hire fee (as listed on website).

  • Refundable security deposit of £250.

3.2 Deposits are refunded once:

  • The trailer is returned on time.

  • The trailer passes inspection and is free from damage, missing parts, excessive dirt, or misuse.

3.3 Payments and refunds are processed via Stripe or other approved methods.


4. Collection & Return

4.1 Collection times must be agreed in advance. The Company may offer 1-hour collection windows.

4.2 Return times are booked in 1-hour slots. The Hirer must return the trailer within the agreed timeframe.

4.3 Late returns may incur charges at £20 per hour unless agreed otherwise.

4.4 Early returns do not qualify for refunds of unused hire time.

4.5 The trailer must be returned:

  • With all keys, straps, accessories, and paperwork.

  • Clean, tidy, and in the same condition as collected (fair wear accepted).


5. Optional Extras

5.1 Optional extras (e.g., tie-down straps) must be selected and paid for before or during collection.

5.2 Loss or damage to extras will be deducted from the deposit.


6. Hirer Responsibilities

6.1 While the trailer is in the Hirer’s possession, they are fully responsible for:

  • Damage to the trailer.

  • Theft or loss of the trailer or accessories.

  • Damage caused by incorrect loading or unsafe towing.

  • Ensuring the load is secure and legal.

6.2 The Hirer must:

  • Use their own legally compliant rectangular number plate.

  • Comply with UK towing laws (speed limits, lighting, load limits, nose weight).

  • Ensure all lights work before leaving collection point.

6.3 If lighting or electrical issues occur during hire, it is the Hirer’s responsibility to rectify them or contact The Company.


7. Breakdown, Accident & Emergency

7.1 If the trailer becomes unroadworthy due to fault:

  • The Company will assess the situation and may recover the trailer at no cost.

  • A replacement may be offered if available (not guaranteed).

7.2 If unroadworthiness is caused by misuse, overloading, incorrect towing, or damage:

  • The Hirer is responsible for recovery costs. If Hampshire Trailer Co provides recovery, this will be billed at £25/hr + £0.5/mile

7.3 In the event of an accident:

  • The Hirer must inform The Company immediately.

  • Provide photos, third-party details, and a full description.

7.4 The Hirer must not abandon the trailer unless instructed by The Company or police.


8. Damage, Loss & Charges

8.1 The Hirer is liable for:

  • All damage caused during the hire period.

  • Repair or replacement costs for damaged lights, wiring, tyres, mudguards, ramps, and other components.

  • Missing straps, keys, number plate holders, pins, or accessories.

8.2 The deposit may not cover all damages; additional charges may apply.

8.3 The Company’s inspection decision upon return is final.


10. Cancellations & No-Shows

10.1 Bookings canceled within 24 hours of pickup may be charged 50% of the hire fee.
10.2 No-shows may be charged the full hire fee.


11. Prohibited Use

The trailer must not be used for:

  • Off-road towing.

  • Transporting hazardous materials.

  • Loads exceeding maximum weight limits.

  • Activities causing unnecessary strain or wear.


12. Liability

12.1 The Company is not responsible for:

  • Hirer’s towing vehicle condition or suitability.

  • Fines, penalties, or legal consequences during the hire.

  • Loss of income due to breakdown or delays.

12.2 The Company’s liability is limited to the cost of hire.


13. Agreement

By collecting the trailer, the Hirer confirms they have:

  • Read and understood these Terms & Conditions.

  • Inspected the trailer and are satisfied it is in good working order.

  • Accepted full responsibility for the trailer during the hire period.
